Introduction

In these Accommodation Terms and Conditions, Albergo della Roccia, located at Via Martiri Della Libertà, 2, 43040 Varano dè Melegari (Parma), VAT No. 01867770347, refers to any natural or legal person who makes a reservation at our Hotel (directly or indirectly, through other means).

Albergo Della Roccia Srl owns, operates, manages, or manages the Albergo della Roccia brand (Hotel), as well as a series of websites and apps for receiving, managing, and accepting Hotel reservations (Websites).

These Accommodation Terms and Conditions apply to reservations at our Hotel. By booking through any means, guests agree to be bound by these Terms and Conditions.

The Hotel may have additional accommodation and booking terms and conditions, which will be communicated at the time of booking or check-in. If reservations are made on other platforms (other than our Websites), additional booking terms and conditions imposed by those platforms may apply (in addition to or in place of the Terms and Conditions set forth below). Again, such conditions or differences will be communicated at the time of booking through the platforms.

General Accommodation Booking Terms and Conditions

By requesting a reservation at our Hotel, and subsequently processing your reservation, you implicitly (unconditionally) accept:

  • our Privacy Policy;
  • if booking on one of our Websites, the Legal Notice regarding the Use of the Website displayed on the applicable Website;
  • these General Accommodation Booking Terms and Conditions (Terms and Conditions); and
  • any additional terms, notices, regulations, and/or instructions provided to you.

We recommend that you carefully read these Terms and Conditions (as well as the policies and conditions set forth above) before requesting or completing your reservation at our Hotels.

We also recommend that you do this each time you make a reservation at our Hotels, as we reserve the right to change, modify, add, or delete portions of these Terms and Conditions at any time.

In the event of any inconsistency between these General Terms and Conditions and any Specific Terms and Conditions, the Specific Terms and Conditions will prevail to the extent of such inconsistency.

1.Booking Confirmation

A reservation at our Hotels becomes valid and binding for the operator of the relevant Hotel only after the operator accepts the reservation, the Customer receives a confirmation email, and we receive payment or a deposit (if required). For this reason, the reservation will require the provision of the requested information, which will be processed in accordance with our Privacy Policy.

2. Secure Payments

When you make a reservation on one of our Websites and pay us, the payment is processed by a payment gateway system that collects and encrypts your card details for subsequent processing. The payment gateways used for this purpose are always secure and comply with legal and technical payment security requirements.

3. Guarantee Policy

A valid credit card is required at the time of booking, and the same credit card must be presented upon check-in at the hotel. Credit cards not in the customer’s name are not accepted (i.e., the credit card and the booking must be in the same name). This is necessary to ensure the reservation and check-in are valid. Failure to present the credit card may prevent access to the hotel.

4. Foreign Currency

The foreign currency conversion shown on the website is indicative and does not represent the exact amount charged for the reservation. The amount charged will be solely that indicated in the booking confirmation.

5. Pricing Errors

We reserve the right to cancel reservations with obvious and obvious errors in the price or service at any time (at no cost to us). In such cases, we will offer the option of rebooking at the correct price and/or with the correct information.

06. Identification

For security reasons, upon arrival at the hotel, you will be required to provide a valid, up-to-date passport or government-issued identity card (or other required identification).

The reservation must be in the name of the person checking in at the hotel.

The credit card information used for the reservation must match the ID provided at check-in.

7. Minors

Minors (in accordance with applicable law in the jurisdiction where the booked hotel is located) staying at the hotel must be accompanied by their parents, authorized teachers, or other duly authorized guardians.

The hotel may require documentation confirming that the minor is accompanied by a parent, authorized teacher, or other guardian.

Only adults (i.e., persons who have reached the age of majority in the jurisdiction where the booked hotel is located) may make reservations at our hotel.

8. No-Shows or Early Cancellations

Failure to provide advance notice in the event of a cancellation or no-show may result in a charge equivalent to the first night’s stay, including VAT or other taxes, to the credit card provided during the booking process (unless otherwise provided in these terms and conditions).

9. Deposit

We may charge a pre-authorization deposit on the customer’s credit card to cover any incidental expenses incurred or any damages caused during the hotel stay. The release of the funds is controlled by the customer’s bank. The deposit amount will be clearly communicated during the booking process.

The pre-authorization affects the available balance and spending limit. For more information on this practice, we recommend contacting your bank. Once the pre-authorization is placed, we will not be able to release, remove, or reduce the authorized amount until the final bill is processed at the time of departure.

10. Privacy

We collect certain personal data from people who make reservations with us and stay at our properties. By making a reservation, the Customer consents to the collection and use of their personal data by us in accordance with the terms of our Privacy Policy. Access to, correction, or deletion of collected personal data is managed in accordance with our Privacy Policy.

11. Use of the Hotel

The Customer agrees to use the Hotel room appropriately and in accordance with these Terms and Conditions during their stay and to return the room at the end of their stay in the same condition as when they checked in.

They also agree to be responsible for any repair costs incurred by us in the event of damage caused to the Hotel during their stay and for any additional cleaning required if the room (or any part of the Hotel) is left in an excessively dirty state. These costs will be those incurred by us, and cleaning will be charged at commercial rates.

The Customer authorizes us to pre-authorize the credit card (provided at check-in) for the necessary amounts.

They also agree to comply with all Hotel signage (relating to their use of the Hotel) and any Hotel Rules or similar rules and guidelines notified to them by us. For your own safety and the comfort of other guests, you also agree to comply with all reasonable instructions provided by Hotel staff, including, in particular, those of our own staff. In these Terms and Conditions, “Hotel Rules” means all rules communicated upon check-in and which must be followed (if applicable). The reception staff will have a copy of these rules available for review upon check-in.

You agree to abide by the Hotel’s established usage and responsibility policies regarding the use of the in-room safe, following the instructions provided.

You agree not to photograph or film any part of the Hotel for commercial purposes without our prior written consent. Please note that photographing or filming other Hotel guests or staff without their express consent is prohibited.

During their stay, we reserve the right to remove any guest from the Hotel if they fail to comply with these Terms and Conditions, any Hotel Rules or staff instructions, or if we believe that their stay at the Hotel may cause us (or others) loss or damage, jeopardize the safety of their guests, ourselves, or others, or bring the Hotel into disrepute. In the event of removal from the Hotel, the cost of the entire stay will be non-refundable and the guest will be required to pay the full amount prior to departure (in addition to any other costs we may be entitled to receive or recover from the guest under these Terms and Conditions or as part of the booking).

12. Facilities (Availability and Maintenance)

From time to time, certain features or facilities of our Hotel may be unavailable or taken out of service for repairs or maintenance, or by order of the owner or management.

If a feature/facility is essential to your hotel selection, we recommend that you contact us before booking to ensure that feature or facility is available at the time of booking.

We will not be responsible for any omissions or errors, temporary or permanent, in the description of our hotel’s facilities and services. Photos displayed on our website (or elsewhere) are indicative only and may not accurately represent the assigned room/apartment.

Destination images on our website may not represent the views visible from our properties.

The accommodation amenities listed may not apply to all room types.

13. Reprotection

In the rare event that we are unable to offer the customer the previously confirmed accommodation, we undertake to reprotect them in another hotel of the same or higher category at no cost to them. If there is no hotel of the same or higher category nearby the originally booked property, we may offer the customer a lower-category hotel. In this case, the customer will be refunded the price difference.

The alternatives offered are at our discretion. If the customer wishes to choose a hotel of a different category than the one offered under this condition, they will be required to pay the difference.

If the customer does not wish to accept the reprotection, the reservation will be cancelled and the customer will receive a full refund.

14. Internet Access

We offer complimentary Wi-Fi internet access that allows guests to connect to the internet.

Our Wi-Fi is operated by a third party, therefore we assume no liability (while using our internet network or Wi-Fi) in the event of:

  • Internet unavailability;
  • Internet speed;
  • availability or access to websites;
  • external intrusion;
  • computer viruses that may enter the Customer’s devices while using the Internet; or
  • unauthorized online transactions or losses incurred by the Customer while using the Internet.

Part of the accommodation reservation fee may include an amount due to us for Internet use. This amount will be indicated on the guest registration card provided upon arrival (if applicable).

15. Force Majeure

The Hotel shall not be liable for any failure or delay in performing its obligations under this Agreement if such failure or delay is due to circumstances beyond its reasonable control, including, but not limited to, natural disasters, fires, floods, earthquakes, war, terrorism, civil unrest, governmental actions, labor disputes, pandemics, epidemics, or any other event that could not be foreseen or prevented by reasonable diligence (“Force Majeure”).

In the event of Force Majeure, the Hotel will communicate with the Guest as soon as possible, explaining the situation and the expected impact, and will attempt to mitigate the impact on the reservation or stay. If unable to fulfill its obligations due to a Force Majeure Event, the Hotel may cancel the reservation and offer the Guest an alternative date or a refund, without further liability.

General Provisions

The following terms and conditions apply to all terms and conditions on this page.

16. Updates

We may modify these Terms and Conditions from time to time by updating this webpage. The modified terms and conditions will be effective upon their posting and will only apply to reservations made after the updates.

17. Severability

If any part of these Terms and Conditions is held to be invalid under applicable law, the affected part will be deleted without affecting the remainder of the Terms and Conditions. The remaining Terms and Conditions will continue to be valid and enforceable.

18. No Waiver

Failure to enforce or insist upon strict performance of any of these Terms and Conditions shall not constitute a waiver thereof.

19. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by, construed, and enforced in accordance with Italian law.

For any dispute relating to these Terms and Conditions and your stay at our Hotel, you agree to submit to the jurisdiction set forth above and to submit (and submit any disputes to) the exclusive jurisdiction of the courts of Parma.

20. Pre-Contractual Information

All reservations made through the Website are subject to the terms and conditions set forth in the respective sections and do not include any conditions not explicitly mentioned. During the booking process, the Customer will be provided with all information related to their reservation on the Website.

If they make a reservation on our Website and have the option to purchase or book additional services offered by us and/or the operator and available outside of the Hotel, either as part of a single transaction or in separate but related transactions, along with their accommodation, the Customer will be provided with all relevant pre-contractual information on the booking page, as well as any specific terms and conditions applicable to those services.

21. Booking Process

The booking process is completed electronically through our website. No prior registration is required by the customer. The contractual relationship between Minor Hotels and the customer is established upon completion of the booking process. By finalizing the booking, the customer expressly accepts all these conditions, which form an integral part of the contract. The reservation will be governed by the applicable rate conditions and applicable laws.

Furthermore, the Hotel reserves the right to verify the validity of the credit card prior to arrival, including through a pre-authorization or a charge not exceeding the amount of the first night. These transactions, which temporarily hold or “block” a specific amount to confirm the validity of the card and/or the availability of funds, are reversed the same day; however, the unblocking or refund period depends solely on the card issuer. If the transaction cannot be processed, the card will be considered invalid and the reservation may be automatically canceled.

Early check-in or late check-out can be arranged upon request, subject to availability and for an additional fee.

The online check-out process allows you to leave your room without visiting the hotel reception and is subject to special terms and conditions, which the guest must accept to use this service. Internet access is via free third-party Wi-Fi. We assume no responsibility for the unavailability or speed of the Internet, the availability or access to websites, external intrusions, computer viruses, unauthorized online transactions, or losses incurred while using the network. Wi-Fi is subject to availability and additional fees may apply.

23. Pets

Pets are allowed if agreed to in writing with us. If a request is made during the booking process, we will communicate our agreement after the hotel operator accepts the booking. Your request will be considered based on availability. Additional charges may apply for stays with pets. This does not apply to properly registered and authorized service animals (where applicable).

24. Consumers from the European Economic Area

If the Customer is a consumer domiciled in the European Economic Area, they may have rights of compensation under national law. We cannot enforce any limitation or exclusion of liability against the Customer if this constitutes a violation of mandatory provisions.

If the Customer is a consumer domiciled in the European Economic Area, these Terms and Conditions will be governed by, interpreted, and enforced in accordance with the laws of the country in which they live, and nothing in these Terms and Conditions shall preclude the application of the remedies provided by mandatory provisions of national law.

The Customer may also access the European Online Dispute Resolution platform offered by the European Commission and available at http://ec.europa.eu/odr for alternative out-of-court dispute resolution for disputes that cannot be resolved between us and the Customer.

25. Specific Terms and Conditions Applicable to Residents of Italy

  • Cancellation and Withdrawal

The Customer has no right of withdrawal. However, the order may be cancelled in accordance with the “Cancellation Policy” as previously stated.

26. Cancellation and Change Policy

Changes and cancellations are permitted up to 72 hours before the day of arrival (the reference time is 2:30 PM local hotel time). Changes or cancellations made after this deadline will incur a penalty equal to the accommodation rate. The full rate will be charged even in the event of a no-show.

As indicated in the general terms and conditions, cancellation penalties for all accommodation rates offered by us are subject to a specific cancellation policy.

  • Reservations benefiting from “Best Flexible Rates”: Changes and cancellations are permitted up to 72 hours before the day of arrival (the reference time is 2:30 PM local hotel time). Changes or cancellations made after this deadline will incur a penalty equal to the accommodation rate. The full rate will be charged even in the event of a no-show.
  • Reservations with “Non-refundable Rates” (or similar): These special rates do not allow changes or cancellations. Unused reservations will be charged the full amount.
  • Reservations with “Long Stay Rates (over 7 days)” (or similar/no less than 4 nights): Changes and cancellations are permitted up to 120 hours prior to the arrival date (the relevant check-in time is 2:30 PM local time). Changes or cancellations after this time will incur a penalty equal to the cost of three nights. A penalty equal to the cost of three nights will also be charged in the event of a no-show.
  • Rates may vary in the event of a change to your stay.
  • If the number of nights originally booked is reduced, the hotel reserves the right to charge the full amount of the stay as a late cancellation penalty.
  • Group and meeting reservations: Cancellation requests will be processed on a case-by-case basis and will be subject to the terms and conditions of the contract or booking applicable to the reservation in question (if applicable). If we agree to change the date of such a reservation, any deposits or down payments may be used for a future reservation within a maximum of 12 months of the original reservation date, after which they will be retained by us.
  • All other hotel reservations: Changes and cancellations are assessed on a case-by-case basis (unless the reservation was made with an authorized third party, in which case the additional terms and conditions governing that reservation will apply).

Late check-out charges will be those communicated by the hotel to the customer and in any case will not exceed the one-night rate as booked (subject to any other charges we may be entitled to charge the customer under these Terms and Conditions, such as cancellation fees).

27. Deposit Policy

In addition to the deposit above, we confirm that we will hold a USD 1 pre-authorization (upon check-in). The time it takes for funds to be released is controlled by the customer’s bank; it may take up to 10 business days.

We reserve the right to pre-authorize all credit cards upon check-in.

Cash is not a form of guarantee or deposit and will not be accepted.

28. Minor Policy

In addition to the general policy regarding minors stated above, minors may use existing beds in the hotel room free of charge, provided that the maximum number of guests allowed per room (as communicated by us) is not exceeded. Any requests for additional rollaway beds, cribs, or sofa beds are subject to a surcharge. Supplement amounts can be obtained at the hotel reception.

For the purposes of this policy, “Minor” means a person between the ages of 2 and 17, and “Adult” means a person 18 or older. All ages will be determined at check-in.
